Political appointees who were elected as delegates to the party’s national conference on Saturday will not be able to vote, according to the All Progressives Congress (APC).

InsightnaijaTV reports that they would be allowed to attend the convention as observers.

The position was announced in a statement on Thursday via the APC National Convention’s official Twitter handle, which is administered by the party’s organising committee’s digital communications sub-committee.

The instruction was issued by the Caretaker Extraordinary Convention Planning Committee (CECPC), which is chaired by Governor Mai Mala Buni.

This is to avoid any legal complications as a result of the controversies surrounding Section 84 (12) of the Electoral Act of 2022, according to the statement released.

">

The statement titled “ATTENTION TO POLITICAL OFFICE HOLDERS WHO WERE ELECTED AS DELEGATES” reads: “The National Caretaker Extraordinary Convention Planning Committee of APC has declared that all political appointees who were elected as delegates to the National Convention slated for 26/3/2022 SHALL NOT VOTE in view of the controversy surrounding Section 84 (12) of the Electoral Act,2022.”

“However, political appointees can still attend as observers.”

President Muhammadu Buhari had written the National Assembly after signing the amended electoral act, requesting that the section be removed because it violated the Constitution and violated the rights of government appointees. However, the National Assembly members declined the President’s request.

However, on Friday, March 18, 2022, Justice Evelyn Anyadike of the Federal High Court in Umahia, Abia State, ruled over by Justice Evelyn Anyadike, directed the Minister of Justice and Attorney-General of the Federation, Abubakar Malami, to delete Section 84 (12) of the modified Electoral Act.

While urging the minister to remove the clause from the Electoral Amendment Act, Justice Anyadike pointed out that it is illegal.

Malami said on Wednesday that the procedure was still in the early stages.

The National Assembly, on the other hand, expressed dismay and anger with the decision, which they claimed was aimed at usurping the legislative powers granted to them by the 1999 Constitution, as amended.

They also directed the Attorney General of the Federation, Abubakar Malami, not to tamper with the law as enacted by the National Assembly until all appeals connected to it have been resolved.
