Ademola Adeleke, the governor of Osun State, has pleaded with the Independent National Electoral Commission (INEC) not to provide former governor Gboyega Oyetola a Certificate of Return in light of the electoral tribunal’s ruling.
In its ruling on Friday, January 27, 20223; the tribunal stated that there was excessive voting in the gubernatorial race. It also stated that when the excessive votes were subtracted, Gboyega Oyetola’s numbers increased to 314, 921, while Adeleke’s statistics decreased to 290, 266.
The tribunal, under the direction of Justice Terste Kume, ordered the Independent National Electoral Commission (INEC) to revoke the certificates of return given to Adeleke and his running mate, Kola Adewusi. It stipulated that Oyetola should get the certificate of return in its place.
However, Adeleke had criticised the decision that removed him from his position as the duly elected governor of Osun State and promised to challenge it, calling it “a miscarriage of justice.”

Shortly after the Osun State Governorship Election Petitions Tribunal invalidated his election as governor, Adeleke urged INEC not to give the certificate of return to Oyetola until the conclusion of his appeal in a letter to INEC Chairman Professor Mahmood Yakubu.
The letter partly signed by Hashim Abioye, Adeleke’s lawyer reads: “As Solicitors to the 2nd Respondent, Senator Ademola Jackson Nurudeen Adeleke, we humbly write to notify you that consequent upon the dissatisfaction of the 2nd Respondent by the najority decision of the Osun State Governorship Election Petition Tribunal delivered on January 27, 2023, the 2nd Respondent has applied for a certified true copy of the judgement to enable him pursue his appeal against the said judgement.”
“In the light of the foregoing, we humbly ask you to apply the relevant provisions of the Electoral Act, 2022, by not issuing any certificate (of) return to the 1st petitioner in the petition pending the outcome of the appeal which we are confident will be favourable to our client.”
