A suit seeking to remove Ebonyi Governor David Umahi and his Deputy, Kelechi Igwe, from office for defection was dismissed by the Court of Appeal Enugu Division on Friday.
The two joined the All Progressive Congress (APC) from the Peoples Democratic Party (PDP) in November 2020. (PDP).
Following their defection, Senator Sonni Ogbuoji, the APC’s governorship candidate in 2019, and his running mate, Justin Ogbodo Mbam, petitioned an Ebonyi High Court to have the Governor and his Deputy sacked.
The plaintiffs requested that the court declare Umahi and Igwe’s seats vacant due to their switch from the PDP to the APC.
Ogbuoji and Mbam also requested that the Court order that they be sworn in as Governor and Deputy Governor immediately after finishing second in the poll.
The claim was dismissed by the High Court on February 28, and the plaintiffs were given N500, 000 in damages.
The plaintiffs filed an appeal after being dissatisfied with the judgment.
The Appellate Court, however, concurred with the lower court’s decision in a 37-minute decision.
In a unanimous decision read by Justice Alfa Belgore, the Appeal Justices dismissed the case as being contradictory to the country’s Constitution and existing legislation.
