Court Dissolves Doctor’s Marriage Over Adultery

An Ibadan High Court in Oyo state has ordered the sale and distribution of assets jointly owned by an Ibadan-based medical doctor named Dr Oluseyi Adebusuyi Seyi-Ojo and his wife, Mrs Olukemi Yewale Seyi-Ojo.

Justice L. A. Ganiyu ruled that two of the properties, the Ayokemi Hospital building and the Dormon Pharmaceutical building, both in Ibadan’s Monatan neighborhood, be sold to people who are not affiliated to either party.

The revenues, according to the judge, should be split between the two.

The order was made by Justice L. A. Ganiyu while delivering judgment in a suit filed by Mrs Seyi-Ojo.

The petitioner had requested a Decree of Dissolution of Marriage against the respondent, her husband.

She claimed that the marriage had irreversibly broken down due to the respondent’s adultery, and that she could no longer live with him.

The petitioner further told the court that she had been separated from the respondent for two years and that she could no longer reconcile with him.

She requested that the court grant her custody of the couple’s second son, as well as an order mandating the respondent to contribute to the son’s upkeep.

She also requested that the hostel in Ogbomoso and the matrimonial residence at Akanni Aluko Street, Monatan, Ibadan, as well as a plot of land in Iwo, be ceded to her.

The petitioner also asked for an order directing the sale of Ayokemi Hospital in Monatan, Ibadan, as well as all other houses except the one purchased in the children’s name, with the proceeds divided evenly.

Justice Ganiyu granted the petitioner’s requests in his ruling, ordering the sale and division of the couple’s jointly owned properties.

The court also approved the sale of the Ayokemi Hospital building on Dejo Dairo Street in Monatan, Ibadan, while the court denied custody of the second son, claiming that he is of legal age to decide where he will live.

The court directed that the parties split the tuition price, but that the respondent pay a maintenance fee of N250, 000 until the kid is gainfully employed.
